22-YEAR-OLD MAN JAILED 20 YERAS FOR DEFILING 15-YEAR-OLD STEP DAUGHTER

22 year man has today started his 20 year jail sentence after Senior Senior Resident Magistrate Court in Thyolo found him guilty in a case he was accused of defiling his 15 year old step daughter.

The court convicted, Edward Phunyanya, on Thursday 29 September, 2022.

State Prosecutor, Sub Inspector Felix Senzani, said prior to the reported defilement case of August 20 this year, Phunyanya also defiled the minor in July.

He said the convict invited the girl into his bedroom after her mother went to church, requesting to have sexual intercourse but the 15 year old denied.

“It was after the girl was coming back from fetching water that Phunyanya dragged her to his bedroom where he defiled her, before threatening her not to reveal the ordeal; saying he will chase her out of the house,” explained Senzani.

The state prosecutor further told the court that on 20 August was caught in the act by a younger sister to the victim.

He said the matter was reported to Goliati Police Unit and a medical examination proved that the minor was known carnally.

Appearing before court, the convict pleaded guilty to the charge of defilement.

In mitigation, the convict pleaded for leniency; claiming he is a first offender and admitted without wasting the court’s time.

However, the state asked for a stiffer punishment saying sexual offences are on the rise in the area and that the convict was supposed to protect the 15 year old girl being a stepfather.

Passing the sentence, Senior Resident Magistrate Asunta Maxwell, concurred with the state and sentenced the convict to 20 years imprisonment with hard labour.

Edward Phunyanya hails from Kajawo village, Traditional Authority Chimaliro in Thyolo district.
